Regulation Of Pharmaceutical Patent Strategy To Improve Access Rights And Quality Of Drugs For BPJS Beneficiaries

Abstract

The Social Security Administering Agency (BPJS) has a strategic role in realising affordable and quality health services for the community. However, the real challenge in achieving this goal is ensuring the availability of effective and affordable drugs for BPJS beneficiaries. Generic drugs are considered to have the potential to overcome this obstacle, so the strategic role of pharmaceutical patents namely exclusive rights granted by the government to owners of innovations in the pharmaceutical sector. can improve access and quality of generic drugs need to be studied comprehensively. This study aims to analyze how pharmaceutical patent strategies can be developed to improve access rights and quality of generic drugs for BPJS beneficiaries. The research method used is a qualitative approach with an in-depth literature study and policy analysis in the form of a legal framework governing pharmaceutical patents in Indonesia and looking at the implementation of pharmaceutical patent strategies in other countries. The results of this study are expected to provide insight into how pharmaceutical patent strategies can be designed and implemented effectively to improve access and quality of generic drugs for BPJS participants. The implications of these findings are expected to support better policy-making in improving health services and the quality of life of BPJS participants through the generic drug aspect. Thus, this study has the potential to make a real contribution to the development of a sustainable and inclusive national health system.
