Abstract

Hospitals are regulated by law no. 17 of 2023, there is a liability for medical services carried out by all medical personnel and other medical personnel in the hospital. A medical service that is not performed by service standards has the potential for claims made by patients or their families. The objective of this study was to analyze the juridical responsibility of hospitals for compensation claims that occur due to medical services performed at the hospital. This study analyzed the roles and liabilities of hospitals and the factors that can lead to claims for compensation in hospital services. This study found that the hospital as an institution has a liability to be responsible for all negligence or services that were not by the standards carried out at the hospital. However, in the process of compensation, the hospital can resolve the dispute fairly by conducting non-litigation and ensuring that all parties involved have the same opportunity and position.
