Bankruptcy And Indonesia's Creative Economy: An Analysis Of Multiplier Impact On The Supply Chain From A Legal And Fiscal Policy Perspective
Abstract
This study analyzes the disconnect between Indonesian Bankruptcy Law (Law No. 37/2004) and the unique characteristics of the Creative Economy (Ekraf), which is dominated by intangible assets (IPR). The Creative Economy sector has a high multiplier effect, so that the bankruptcy of one entity can trigger a collapse of liquidity throughout the supply chain (domino effect). From a normative-empirical perspective, this study identifies weaknesses in the valuation and protection of IPR during the bankruptcy process that amplify systemic risk. Furthermore, this study criticizes the lack of synchronization between these legal mechanisms and specific Fiscal Policies that can function as risk mitigation or rescue schemes (bailouts). The main contribution of this study is to formulate tailor-made policy recommendations that integrate preventive fiscal instruments with improvements in legal procedures to ensure the resilience and sustainability of the Creative Economy.
